{"id":751,"date":"2016-10-28T05:07:53","date_gmt":"2016-10-28T05:07:53","guid":{"rendered":"https:\/\/ubaltlawcfcc.wordpress.com\/?p=751"},"modified":"2020-10-26T20:59:05","modified_gmt":"2020-10-26T20:59:05","slug":"from-therapeutic-jurisprudence-to-roper-when-social-science-serves-as-authority-in-law","status":"publish","type":"post","link":"https:\/\/blogs.ubalt.edu\/cfcc\/2016\/10\/28\/from-therapeutic-jurisprudence-to-roper-when-social-science-serves-as-authority-in-law\/","title":{"rendered":"From Therapeutic Jurisprudence to Roper: When Social Science Serves as Authority in Law"},"content":{"rendered":"<p>By Andrew Siske, CFCC Student Fellow (2016-2017)<\/p>\n<p>Early on as a CFCC Student Fellow, I learned about therapeutic jurisprudence (TJ), which can be defined as \u201cthe study of the role of law as a therapeutic agent.\u201d<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> \u00a0TJ represents a <em>normative<\/em> understanding of law which aims to identify the beneficial and harmful consequences of law, with the goal of bolstering the former while minimizing the latter.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> \u00a0Toward this end, TJ \u201cseeks to apply <em>social science<\/em> to examine law\u2019s impact on the mental and physical health of the people it affects.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>During our weekly seminars, the Student Fellows have been exposed to several notable examples of TJ in practice, such as problem-solving courts,<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> the use of restorative practices for student discipline,<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> and the implementation of Unified Family Court models.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> \u00a0As interesting as I\u2019ve found these applications, my curiosity has been aroused most by TJ\u2019s theoretical basis and its most basic implicit normative claim that social science <em>should<\/em> inform the development of law. \u00a0Consequently, the CFCC Student Fellows Program has left me most curious to understand this question: To what extent can social science serve as an <em>authority<\/em> to law?<\/p>\n<p>The Supreme Court has considered \u2013 indeed relied on \u2013 social science in coming to some controversial holdings. Take, for example, <em>Roper v. Simmons<\/em>, a 2005 decision in which a 5-4 majority held that executing an individual who committed a capital crime before turning eighteen constituted cruel and unusual punishment in violation of the Eighth Amendment.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> \u00a0In reaching this decision, the court relied heavily on research from developmental psychologists to establish that adolescents were categorically less culpable than adults.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> \u00a0Specifically, the Court drew from psychological theory and research to establish the following \u201c[t]hree general differences\u201d between minors and adults:<\/p>\n<ol>\n<li>Minors are generally less mature than adults<\/li>\n<li>Minors have an increased vulnerability to outside influences, such as peer pressure, and<\/li>\n<li>Minors\u2019 character structures are comparatively \u201ctransitory.\u201d<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><\/li>\n<\/ol>\n<p>The Court concluded that these differences \u201crender suspect any conclusion that a juvenile falls among the worst offenders.\u201d<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/p>\n<p>While <em>Roper<\/em> was far from the first instance when the Supreme Court found that adolescents differ from adults, the extent to which it embraced developmental science in reaching its decision was \u201cnew and noteworthy.\u201d<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> \u00a0However, while it reached an exciting conclusion, the <em>Roper<\/em> Court neglected to explain the methods used by its cited studies or why these studies were particularly authoritative. \u00a0Indeed, Justice Scalia offers this very critique in a scathing dissent, in which he accuses the Court of \u201cpicking and choosing [studies] that support its position.\u201d<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> \u00a0As much as I agree with the conclusion in <em>Roper<\/em>, I can\u2019t help but agree with Justice Scalia that the majority inadequately justified its use of the particular studies it cited.<\/p>\n<p>Reading <em>Roper<\/em> has left me wondering how social science will be used in future legal decisions and to what extent TJ\u2019s success is connected to the Supreme Court\u2019s acceptance of social science as a legitimate source of authority.<\/p>\n<p>To what extent do you think social science should serve as an authority in Supreme Court jurisprudence and in courts in general?<\/p>\n<p>If you think social science can properly inform law, to what extent do you believe the Court is obligated to describe the research or theory it uses? \u00a0How much detail or what details would suffice?<\/p>\n<p>Do you think the long-term viability of therapeutic jurisprudence depends at all on whether social science is accepted as a source of authority in the courts? \u00a0Or will TJ and its practical applications thrive, regardless of whether social science is acknowledged as legitimate authority by the courts?<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Bruce J.
