United States<\/em><\/a>, the Facebook &#8220;true threats&#8221; case. Given the buzz over this case, I&#8217;m going to interrupt my current <a href=\"http:\/\/blogs.ubalt.edu\/cstarger\/2014\/11\/24\/calibrating-crawford\/\" target=\"_blank\" rel=\"noopener noreferrer\">series on the\u00a0Confrontation Clause<\/a>\u00a0in order to briefly consider the doctrinal network at issue in <em>Elonis<\/em>. Let&#8217;s jump right in.<\/p>\n<p>According to the <a href=\"http:\/\/www2.ca3.uscourts.gov\/opinarch\/123798p.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">3rd Circuit opinion under review<\/a>, the Supreme Court &#8220;first articulated the true threats exception to speech protected under the First Amendment in <em>Watts v. United States <\/em>(1969)<em>.<\/em>&#8221; \u00a0The latest SCOTUS true threats case is <em>Virginia v. Black<\/em> (2003). The specific doctrinal question in <em>Elonis<\/em> is whether the true threats exception requires a jury to find the defendant subjectively intended his statements to be intended as threats. The 3rd Circuit concluded that no subjective intent was required. Based on the <em>Black<\/em> and <em>Watts<\/em> endpoints, we can easily generate a simple network.<\/p>\n<p><a href=\"https:\/\/home.ubalt.edu\/id86mp66\/In%20Progress\/08_True_Threats_Unfiltered.html\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-148\" src=\"http:\/\/blogs.ubalt.edu\/cstarger\/wp-content\/uploads\/sites\/273\/2014\/12\/08_True_Threats_Unfiltered.jpg\" alt=\"08_True_Threats_Unfiltered\" width=\"1029\" height=\"717\" \/><\/a><\/p>\n<p>As shown in the map above, <em>Black<\/em> directly cites <em>Watts<\/em> (1 degree connection). <em>Black<\/em> also cites <em>RAV v. St. Paul<\/em>, which in turn cites <em>Watts<\/em> (2 degree connection). All the light blue cases form the 3-degree network. The magenta case line is a very specific 4-degree connection to Rogers v. United States. I wanted to include this because the 3rd Circuit in <em>Elonis<\/em> made reference to Justice Marshall&#8217;s concurring opinion in <em>Watts<\/em> to buttress its view on subjective intent.<\/p>\n<p>Of course, not all the cases in the network above directly concern threats. In order to have a sharper view of the doctrine at issue, I ran the network above through a text filter <a href=\"https:\/\/www.courtlistener.com\/search\/advanced-techniques\/\" target=\"_blank\" rel=\"noopener noreferrer\">using Courtlistener&#8217;s API<\/a>. Specifically, I asked the Mapper to display only those cases where the &#8220;threats&#8221; appeared in opinion text. Here is the result.<\/p>\n<p><a href=\"https:\/\/home.ubalt.edu\/id86mp66\/In%20Progress\/09_True_Threats_Filtered.html\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-150\" src=\"http:\/\/blogs.ubalt.edu\/cstarger\/wp-content\/uploads\/sites\/273\/2014\/12\/09_True_Threats_Filtered.jpg\" alt=\"09_True_Threats_Filtered\" width=\"879\" height=\"733\" \/><\/a><\/p>\n<p>Although I \u00a0have not read the cases in this map, I strongly suspect that the doctrinal analysis\/debates \u00a0contained in these cases will come into play in the Court&#8217;s <em>Elonis<\/em> deliberations. Readers interested in checking out the cases can do so easily by clicking on the images above and then clicking on any opinion &#8212; the Courtlistener page will pull right up.<\/p>\n<p>Hopefully, this map demonstrates one application of using network theory to study Court doctrine. It can quickly generate &#8220;potential reading lists&#8221; for advocates and scholars interested in surveying any given doctrinal area based on given case endpoints. Of course, generating real insights requires reading the texts closely.
