{"id":87,"date":"2014-11-11T15:38:03","date_gmt":"2014-11-11T15:38:03","guid":{"rendered":"http:\/\/blogs.ubalt.edu\/cstarger\/?p=87"},"modified":"2022-06-11T20:15:16","modified_gmt":"2022-06-11T20:15:16","slug":"city-of-shelby-new-scotus-pleadings-opinion-in-visual-context","status":"publish","type":"post","link":"https:\/\/blogs.ubalt.edu\/cstarger\/2014\/11\/11\/city-of-shelby-new-scotus-pleadings-opinion-in-visual-context\/","title":{"rendered":"City of Shelby: New SCOTUS Pleadings Opinion in Visual Context"},"content":{"rendered":"<p>Yesterday, the Supreme Court issued a summary reversal of the Fifth Circuit\u00a0in <em><a href=\"https:\/\/www.courtlistener.com\/opinion\/2750101\/johnson-v-city-of-shelby\/\" target=\"_blank\" rel=\"noopener noreferrer\">Johnson v. City of Shelby<\/a><\/em>. The short\u00a0per curiam opinion represents the latest chapter in the Court&#8217;s recently-controversial doctrine interpreting the requirements for federal pleadings under FRCP 8(a)(2). Working in collaboration with civ pro guru <a href=\"http:\/\/www.uchastings.edu\/academics\/faculty\/facultybios\/dodson\/index.php\">Prof. Scott Dodson<\/a> of UC Hastings, I have <a href=\"http:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2422160\" target=\"_blank\" rel=\"noopener noreferrer\">charted out\u00a0this doctrinal territory<\/a> before. Today&#8217;s map is\u00a0thus as updated look that places <em>City of Shelby<\/em> in its visual context.<\/p>\n<p><a href=\"http:\/\/blogs.ubalt.edu\/cstarger\/wp-content\/uploads\/sites\/273\/2014\/11\/04_City_of_Shelby_pleadings.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-90\" src=\"http:\/\/blogs.ubalt.edu\/cstarger\/wp-content\/uploads\/sites\/273\/2014\/11\/04_City_of_Shelby_pleadings.jpg\" alt=\"04_City_of_Shelby_pleadings\" width=\"1200\" height=\"972\" \/><\/a><\/p>\n<p>Note that this map uses a custom schema where the Y-axis represents the relative liberality of a pleadings opinion. Upward-pointing triangles represent cases where the Court found a claim was stated under 8(a)(2); downward pointing triangles represent cases where no claim was stated. Green citation lines represent positive citations to prior caselaw; yellow citation lines represent limiting or negative citations. (For a detailed\u00a0explanation of this schema, please <a href=\"https:\/\/vimeo.com\/89845875\" target=\"_blank\" rel=\"noopener noreferrer\">see this video<\/a>).<\/p>\n<p>I have placed <em>City of Shelby<\/em>\u00a0on the higher end\u00a0of liberality spectrum because the opinion specifically invoked two liberal pleadings opinions in support of its result &#8212; <em><a href=\"https:\/\/www.courtlistener.com\/opinion\/112825\/leatherman-v-tarrant-county-narcotics-intelligence\/\" target=\"_blank\" rel=\"noopener noreferrer\">Leatherman<\/a><\/em> and <em><a href=\"https:\/\/www.courtlistener.com\/opinion\/118482\/swierkiewicz-v-sorema-na\/\" target=\"_blank\" rel=\"noopener noreferrer\">Swierkiewicz<\/a><\/em> (thus the green lines of citation). The opinion also made clear that its famously illiberal opinions <a href=\"https:\/\/www.courtlistener.com\/opinion\/145730\/bell-atlantic-corp-v-twombly\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Twombly<\/em><\/a> and <a href=\"https:\/\/www.courtlistener.com\/opinion\/145875\/ashcroft-v-iqbal\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Iqbal<\/em><\/a> were &#8220;not on point&#8221; because those cases concerned &#8220;substantive plausibility&#8221;, which was not at issue given\u00a0the plaintiff had indeed &#8220;<span style=\"color: #222222\">stated simply, concisely, and directly events that, they alleged, entitled them to damages from the city.&#8221; Plaintiff in this case had merely failed to invoke 42 USC 1983 in its civil rights complaint and the Court warned against a &#8220;further insistence on a punctiliously stated &#8216;theory of the pleadings.&#8217;\u201d This limitation on\u00a0the reach of <em>Iqbal<\/em> and <em>Twombly<\/em>\u00a0is represented by yellow lines of citation.<\/span><\/p>\n<p>At this juncture, <em>City of Shelby<\/em> seems to represent the next stage in what Prof. Dodson and I have described as a &#8220;genuine uptick in pleading liberality.&#8221; While <em>Iqbal<\/em> represented a low in liberality, the Court has since handed a series of victories to plaintiffs (<a href=\"https:\/\/www.courtlistener.com\/opinion\/212969\/matrixx-initiatives-inc-v-siracusano\/\" target=\"_blank\" rel=\"noopener noreferrer\">Matrixx<\/a>, <a href=\"https:\/\/www.courtlistener.com\/opinion\/206098\/skinner-v-switzer\/\" target=\"_blank\" rel=\"noopener noreferrer\">Skinner<\/a>, and now City of Shelby) that might\u00a0assuage the fears of commentators worried about\u00a0&#8220;the end of notice pleading.&#8221; Of course, it is also possible that this per curiam opinion will go largely unnoticed and uncited. This seems to be the fate that has befallen <a href=\"https:\/\/www.courtlistener.com\/opinion\/145722\/erickson-v-pardus\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Erickson<\/em><\/a>, a \u00a0prior per curiam pleadings opinion.<\/p>\n<p>Only time will tell.<\/p>\n<p>UPDATE: The <a href=\"http:\/\/law.ubalt.libguides.com\/content.php?pid=627751&amp;sid=5214085\" target=\"_blank\" rel=\"noopener noreferrer\">SCOTUS Mapper Library<\/a> now contains a version of this map <a href=\"https:\/\/home.ubalt.edu\/id86mp66\/17_City_of_Shelby_pleadings.html\" target=\"_blank\" rel=\"noopener noreferrer\">with links to underlying opinions<\/a>.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yesterday, the Supreme Court issued a summary reversal of the Fifth Circuit\u00a0in Johnson v.
